Official Rules

Thank you for supporting the 20/30 Ford King Ranch Truck Raffle (the “Raffle”), presented by The 20/30 Club of Topeka, Inc. (the “Organizer”), to raise funds for the ongoing charitable activities and purposes of Topeka Community Foundation, a Kansas nonprofit corporation and tax-exempt organization under Section 501(c)(3) of the Internal Revenue Code. The rules (the “Rules”) of the Raffle, as set forth below, shall govern the Raffle, award of prizes, and participation in the Raffle. These Rules bind every person who buys or otherwise holds a raffle ticket. By purchasing a ticket, each Eligible Ticket Purchaser and/or Ticket Holder agrees (a) to be bound by these Rules and (b) that Organizer’s interpretation and application of these Rules is conclusive and final.

The Grand Prize Drawing will take place upon the sale of 4,500 raffle tickets, or on June 30, 2021, at 3:00 p.m., whichever occurs sooner (the “Grand Prize Drawing Date”). The final ticket purchase deadline for entry is June 29, 2021, at 5:00 p.m. CST, or at such time as 4,500 tickets are sold, whichever occurs sooner (the “Final Ticket Purchase Deadline”). Only 4,500 raffle tickets will be sold.

Purchaser Eligibility

To be eligible to purchase a raffle ticket, a ticket purchaser (an “Eligible Ticket Purchaser”) must (a) be at least 18 years old at the time of purchase, (b) be a U.S. resident physically residing in the United States or District of Columbia, and (c) not be precluded by Applicable Law (as that term is defined in the “Registration with the State of Kansas and Applicable Law” section of these Rules) from holding or purchasing a ticket or participating in a raffle.

A person cannot purchase a raffle ticket or be an Eligible Ticket Purchaser if such person is a person (a) with whom U.S. persons or entities are restricted from doing business under regulations of the Office of Foreign Asset Control of the Department of the Treasury (including those named on OFAC’s Specially Designated and Blocked Persons List”) or under any statute or executive order or (b) who is acting, directly or indirectly, for or on behalf of any such person.

Topeka Community Foundation and Raffle Auditor’s board members and employees, and members of their household, may not purchase a raffle ticket and are not eligible to win a prize. Organizer’s board members, and members of their household, may not purchase a raffle ticket and are not eligible to win a prize.

Organizer reserves the right to require reasonable evidence of the eligibility of an Eligible Ticket Purchaser at any time and to void any ticket sold to a person who does not meet the eligibility requirements or who is otherwise precluded by Applicable Law from holding a ticket, participating in a raffle, or winning a prize.

Raffle Ticket Information

Only one Eligible Ticket Purchaser, as defined herein, may purchase a raffle ticket. This means, (a) one name per ticket and (b) one purchaser per ticket. Only the Eligible Ticket Purchaser named on the raffle ticket (the “Ticket Holder”) shall be eligible to win any prize and Organizer shall have no duty or obligation with respect to the division of any prize and all Eligible Ticket Purchasers and/or Ticket Holders release and shall hold harmless Organizer from all claims relating to the award of the prize or its division among other persons or entities.

Only 4,500 raffle tickets will be sold. The odds of winning one or more prizes will depend on the number of tickets sold. If Organizer sells all 4,500 tickets, the odds of winning the Grand Prize are 1 in 4,500. The overall odds of winning one of the 3 prizes is 1 in 1,500. If Organizer sells less than 4,500 tickets, or adds additional drawings or prizes, the chance of winning a prize will increase.

How to Purchase Tickets

Eligible Ticket Purchasers may purchase raffle tickets online at www.2030gala.org. At the time of purchase, Eligible Ticket Purchasers must provide their name, address, phone number, email address, credit card number, credit card security code and expiration date, and such other information as Organizer may require.

Tickets will be distributed, and ticket numbers will be assigned, to Eligible Ticket Purchasers, as Ticket Holders, in the order that payment is received. All payments will be deposited upon receipt. Organizer reserves the right to reject any entry form that it deems defective, illegible, ineligible, or submitted without good funds.

In accordance with Applicable Law, Organizer will not mail raffle tickets to Eligible Ticket Purchasers. Organizer will email unofficial raffle tickets as receipts for ticket purchases to the Eligible Ticket Purchaser, as Ticket Holders, within five (5) days of purchase to the email address provided by the Eligible Ticket Purchaser. Hard copies of official tickets are available upon written request to Organizer. To win a prize, Ticket Holders do not need (a) to possess a hard copy of a raffle ticket and (b) do not need to be present at a drawing.

All raffle ticket sales are final. Organizer will make no refunds except under the following circumstances: Organizer will return any payment that Organizer receives after (a) it has sold 4,500 tickets or (b) after the Final Ticket Purchase Deadline. No other refunds are available, except at the sole discretion of Organizer.

Drawing Information

Grand Prize Drawing: The Grand Prize Drawing will take place within thirty (30) days of the date of the sale of the final raffle ticket (4,500), or on June 30, 2021, at 3:00 p.m., whichever occurs sooner. In the event that the Grand Prize Drawing will take place prior to June 30, 2021, Organizer will notify each Ticket Holder, via the email provided, of the date, time, and location of the drawing at least fourteen (14) days in advance thereof.

Purchase Deadline: June 29, 2021, at 5:00 p.m., or upon the sale of 4,500 tickets, whichever occurs sooner.

Drawing Location: 6410 SE Forbes Ave., Topeka, KS 66619, and via Facebook Live.

All drawings will be conducted, supervised, and audited by the independent accounting firm of Knudtson & Company CPAs, P.A. (“Raffle Auditor”). At the Grand Prize Drawing, a raffle ticket for the Grand Prize will be drawn first. A raffle ticket for the Second Prize will be drawn second. A raffle ticket for the Third Prize will be drawn third. One raffle ticket shall be eligible to win only one (1) prize.

At the discretion of Organizer and subject to approval of the Kansas Department of Revenue, Organizer may extend or modify ticket purchase deadlines, and drawing dates, times, and locations. Any changes to the Raffle drawings will be posted on www.2030gala.org and all current Ticket Holders will be notified by email. A list of Raffle winners will be posted on the Raffle website at www.2030gala.org. The Raffle Auditor is the final authority in the event of any disputes regarding any of the drawings or the Raffle procedures.

Raffle Prizes

Grand Prize: 2020 Ford King Ranch Truck

Second Prize: All-Inclusive Cancun Vacation

Third Prize: $1,000 Cash

Vehicle Prizes: The winning Ticket Holder of any vehicle prize is solely responsible for any and all state or local license, title, registration, taxes, or fees associated with the vehicle, as well as insurance (proof of which must be shown prior to delivery), and any pickup or delivery costs. The winning Ticket Holder of any vehicle prize shall hold harmless, and if necessary, indemnify Organizer, for any costs, expenses, losses, or other liabilities relating to the foregoing.

Vehicle Prize Restrictions: The prize vehicle will come as described and be offered to the winner with a factory warranty, without additional warranty of any kind, express or implied. The prize vehicle is non-assignable and non-transferable, except with the prior written consent of Organizer and at the sole discretion of Organizer. The winner of any prize vehicle is solely responsible for any applicable taxes on the prize vehicle and for all vehicle registration, license, title and insurance fees, as well as all costs associated with any available upgrade/option packages or equipment not provided with prize vehicle and any other expenses related to the acceptance and use of the prize not specified. Winner must pay in advance to Organizer all applicable taxes and fees and must pick up or take delivery of the vehicle within sixty (60) days of Formal Notice, as defined herein, to the prizewinner. Should the prizewinner of any vehicle prize fail to pay in advance to Organizer all applicable taxes and fees within sixty (60) days of Formal Notice to the prizewinner, or otherwise fail to comply with these Rules or Applicable Law, the prize may be forfeited the discretion of Organizer. Winner must provide valid U.S. driver’s license and evidence of insurance prior to pick up or delivery. Vehicle awarded may differ slightly from vehicle displayed in promotional materials.

Vacation Prizes: Vacation travel prizes are as described on the Raffle website. Flight voucher is provided in the form of a Visa Gift Card, or similar payment method, not to exceed $1,000. Accommodation and booking arrangements are made between vacation prize winner and Organizer. Winner must contact Organizer within thirty (30) days of Formal Notice to the winner and provide requested dates, which are subject to availability, of travel or prize may be forfeited, at Organizer’s discretion. Travel must be used within six (6) months of the Grand Prize Drawing Date. All gratuities, taxes and fees are the responsibility of the winner and each vacation prize has a maximum value of no more than $4,999.00 in total. Winners of travel related prizes must comply with all applicable requirements and restrictions related to said prizes including without limitation applicable travel dates, age restrictions, liability waivers, travel documentation and reservation and confirmation procedures. All vacations are subject to availability and may be substituted with a comparable vacation prize at Organizer’s discretion.

Cash Prizes: Organizer will deliver cash prizes to prizewinners by U.S. mail, wire transfer, or other mutually acceptable means.

Additional Prizes: Organizer may add merchandise alternative prizes to any current prize. If Organizer adds alternative prizes, the winner may choose between the merchandise alternative and the original prize advertised. Organizer may add prizes and additional drawings at any time. If additional drawings are added with the approval of the Kansas Department of Revenue, it is the obligation of Organizer to inform all purchasers of tickets, both past and future, of these additions via email.

Rules Applicable to All Ticket Holders and All Prizewinners

Organizer will make reasonable efforts to contact prizewinners using information provided on the winning entry form. If a prizewinner does not contact Organizer within  fourteen (14) days after the first initial contact notifying the prizewinner of their winnings, then Organizer shall give notice to such prizewinner by U.S. Postal Service certified mail, return receipt requested, at the address set forth in the information provided by the Eligible Ticket Purchaser (“Formal Notice”). This Formal Notice shall state (a) the prize won, (b) a telephone number of a contact person at Organizer, (c) the time and location where the prize(s) can be claimed, and (d) that if the prize has not been claimed within thirty (30) days of the date the notification is given, that the prize may be forfeited, at Organizer’s discretion. 

Organizer will not award a prize if the prizewinner (a) was ineligible to purchase a ticket or otherwise enter the Raffle, (b) provided materially false or misleading information to Organizer in connection with the purchase of a Raffle ticket, or (c) if participating in this Raffle or receiving a prize is prohibited with respect to such person pursuant to these Rules or Applicable Law. A Ticket Holder cannot assign or transfer his/her interest in a raffle ticket, or a prize won by a winning raffle ticket, except as may be approved by Organizer and in Organizer’s sole discretion.

As a condition to being eligible to receive a prize, each prizewinner must sign and deliver to Organizer: (a) a sworn affidavit of eligibility under these Rules and Applicable Law and satisfactory proof that he/she is the person named on the winning entry; (b) a correct taxpayer identification number (e.g., social security number, individual taxpayer identification number, or employer identification number), (c) satisfactory proof that the purchaser of the ticket was an Eligible Ticket Purchaser at the time the ticket was purchased; (d) a publicity release, and (e) such other matters as Organizer may reasonably request, such as proof of identification and proof of address to determine authenticity of individual claiming a prize. If the holder of a winning ticket does not provide a correct taxpayer identification number or otherwise comply with Applicable Law and these Rules, then Organizer may, at its option, disallow the award of the prize to such Ticket Holder.

Winners of a Raffle prize authorize Organizer to withhold all required amounts and report the award of Raffle prizes in accordance with Applicable Law. With respect to non-cash prizes exceeding $5,000 in total value, including the prize vehicle, Applicable Law requires that the winner of the prize pay in advance to Organizer 24% of the fair market value of the prize, which Organizer will remit such payment to the IRS. The winner shall also pay in advance any sales tax associated with the prize or any other taxes required by Applicable Law. If the winner does not pay in advance to Organizer the amounts necessary to comply with Applicable Law and these Rules within sixty (60) days of Formal Notice, then, the prize may be forfeited, at Organizer’s sole discretion. Prizewinners must pick up their prizes or arrange for delivery of their prizes and pay in advance all costs associated therewith. The IRS has taken the position that amounts paid for chances in raffles, lotteries or similar drawings for valuable prizes are not gifts and therefore do not qualify as deductible charitable contributions.

In the event that any prize is forfeited, is not claimed in accordance with these Rules, or if the winner of any prize cannot be located with reasonable diligence within forty-five (45) days from the date of the drawing, the prize shall be awarded by conducting a secondary drawing using the original pool of raffle tickets. In the event of a secondary drawing, Organizer will notify each Ticket Holder, via the email provided, of the date, time, and location of the secondary drawing at least fourteen (14) days in advance thereof.

Each Eligible Ticket Purchaser and/or Ticket Holder agrees their name, likeness, voice and city of residence may be recorded by audio, video, or digital means and may be used in any print, audio or visual media without notice or compensation for any purpose including related to this Raffle or any other  promotional purposes of Organizer.

Each Eligible Ticket Purchaser and/or Ticket Holder (a) agrees Organizer, Topeka Community Foundation, Raffle Auditor, and their directors, officers, employees, agents, and representatives, are not responsible for any injuries, losses, or damages of any kind arising in connection with, or as a result of, this Raffle and/or that person’s failure to win or redeem any prize, or that person’s award of, acceptance of, or use of, any prize; and (b) releases and agrees to indemnify, defend, protect, and hold harmless Organizer, Topeka Community Foundation, Raffle Auditor, officers, directors, shareholders, employees, agents, advertising agency, contractors, insurers, attorneys, accountants, and affiliated entities from and against all losses, damages, rights, claims, and actions of any kind arising in connection with, or as a result of, this Raffle and/or that person’s failure to win or redeem any prize, or that person’s award of, acceptance of, or use of any prize, or that person’s failure to comply with Applicable Law; and (c) represents and warrants to Organizer that they have read and understand these Rules and agree to be bound by these Rules and Organizer’s decisions, which are final.

The Kanas Department of Revenue (KDOR) is the regulatory authority with jurisdiction over charitable gaming. If and to the extent KDOR expressly deems a specific dispute between Organizer and person purchasing or holding a ticket outside of KDOR’s authority, the Organizer and that person agree that if there is a dispute of any kind regarding the award of a prize or the conduct of the Raffle, Organizer and all persons purchasing or holding a ticket agree to arbitrate such dispute. Such dispute shall be decided by binding arbitration in accordance with the rules of the American Arbitration Association then in effect and shall be governed by the United States Arbitration Act (9 U.S.C. §§ 1-16). While such arbitration is pending, Organizer, in its sole and absolute discretion, may deposit the prize with the then Clerk, or acting Clerk, of the District Court of the County of Shawnee, State of Kansas, interplead the parties hereto, and upon so depositing such prize and filing its complaint in interpleader it shall be relieved of all liability under the terms hereof as to the property so deposited. By the purchase of a ticket, all persons purchasing or holding a ticket (a) do submit themselves to the jurisdiction of said court and appoint the then Clerk, or acting Clerk, of said court as their Agent for the service of all process in connection with such proceedings and consent to the arbitration of disputes between them.

Registration with the State of Kansas and Applicable Law

This Raffle is being conducted pursuant to Raffles License # RAF000151 issued to The 20/30 Club of Topeka, Inc., by the Kansas Department of Revenue, and is being conducted in accordance with the applicable provisions of the Kansas Charitable Gaming Act, K.S.A. 75-5171, et seq., as amended, Kansas Department of Revenue Administrative Regulations K.A.R. 92-23-70 through K.A.R. 92-23-75, as amended, the Internal Revenue Code, any other rules or regulations governing the conduct charitable gaming in the state of Kansas (“Applicable Law”).

The Raffle is subject to these Rules, the laws of the state of Kansas, and Applicable Law. If there is a conflict between these Rules and the laws of the state of Kanas, the laws of the state of Kansas shall govern. Organizer reserves the right to modify the Rules and/or impose additional conditions, procedures, and requirements as may be necessary or required for the Raffle and the award of prizes hereunder to comply with the laws of the state of Kansas and Applicable Law. This Raffle is void where prohibited by law.
